Trademarks

Filing Requirements:

1.   Power of attorney legalized up to the UAE Consulate.

2.   Certified copy of the priority document legalized up to the UAE consulate if priority to be claimed.

3.   Ten prints of the mark not exceeding (5cm x 5cm)

4.   The name, Address, Nationality of the applicant and nature of business of the applicant

5.   The list of goods and classes to be covered by the application

Renewal Requirement:

1.   Power of attorney legalized up to the UAE Consulate.

2.   Copy of the trademark certificate of registration.

Assignment Requirement:

1.   A legalized power of attorney by the assignee up to the UAE Consulate.

2.   Legalized Deed of assuagement executed by both parties.

3.   Original certificate of registration of the trademark.

Kindly note the following points:

1.   Time frame from filing up to registration is about 12-15 months.

2.   Trademarks are registered for 10 years and renewable for another 10 years.

3.   Opposition period is for one month as from publication date.

Patents

Filing Requirements:

1.   Power of attorney legalized up to the UAE Consulate.

2.   Legalized extract from the Commercial Register or from the Memorandum of Association if the applicant is a company or body corporate.

3.   One set of the drawings relating to the invention, if there any.

4.   One copy of the English specification and claims together with its Arabic translation.

5.   An abstract of the invention of no more than 200 words, together with the best explanatory diagram.

6.   Legalized deed of assignment signed by the inventor, if the applicant is not the inventor.

7.   Certified copy of the application giving the filing date, number and country if the application is to be filed with a priority claim.

Regarding the PCT applications entering the national phase in the UAE, a copy of the PCT international publication search and examination reports must be submitted with the application.

Ps. UAE Patent Office has recently started examining patent applications through the Austrian Patent Office. The UAE Patent Office is currently transferring applications filed in 1998.

Designs

Filing Requirements:

1.   Power of attorney legalized up to the UAE Consulate.

2.  Two copies of the model or design if it is two-dimensional or two copies of each view thereof, if it is three-dimensional.

3.      Legalized extract from the Commercial Register or from the Memorandum of Association if the applicant is a company or body corporate.

4.   Legalized deed of assignment signed by the inventor, if the applicant is not the inventor.

5.   Certified copy of the priority document if it is to be claimed. Please be advised that the Patent Office in the UAE is only accepting applications. Examination of filed design applications has yet to start. Therefore, no designs have been granted yet.
