Trademarks

Filing Requirements:

1.   Power of attorney legalized up to the Omani Consulate.

2.   Certificate of Incorporation or extract from the commercial register legalized up to the Consulate.

3.   10 Prints of the trademark.

4.   If priority is claimed, a certified copy of the priority document should be submitted to the Trademark Office in Oman within three months of filing date.

5.   The name, Address, Nationality of the applicant and nature of business of the applicant.

6.   The list of goods and classes to be covered by the application

Renewal Requirement:

1.   Power of attorney legalized up to the Omani Consulate.

2.   Number and registration date of the trademark.

3.   The name, Address, Nationality of the applicant and nature of business of the applicant.

Assignment Requirement:

1.   Power of attorney legalized up to the Omani Consulate by the assignee.

2.   Deed of assignment executed by both the assignor and the assignee and legalized up to the Omani Consulate.

3.   Certified copy of the certificate of incorporation or extract from the commercial register of the assignee legalized up to the Omani Consulate.

Kindly note the following points:

1.   Time frame from filing up to registration is about 48-50 months.

2.   Trademarks are registered for 10 years and renewable for another 10 years.

3.   Opposition period in Oman is for 30 days as from publication of the trademark.

Patents

Filing Requirements:

Patents protection in Oman can be obtained under the Gulf Cooperation Council (GCC).

Designs

Publication of Cautionary Notice is Available in Oman Under the Following Conditions:

1.   The little of the patent or design and particulars of corresponding foreign registration, if there is any.

2.   A summary description or any other information regarding the invention if the owner desires to have such particulars published.

3.   The name, nationality, address, and profession or nature of business of the owner.
