Trademarks

Filing Requirements:

1.   A power of attorney notarized and legalized up to the Sudanese Consulate.

2.  Legalized Extract from the commercial register or certificate of incorporation up to the Sudanese Consulate.

3.   Sixteen prints of the trademark for each class.

4.   The list of the goods service to be covered by the application, one application should not cover all goods in one class.

5.   Meaning of trademark if any in case of word mark.

6.   When the application matures into registration, the Registrar requests a simply signed declaration on the applicants’ letterhead paper stating that the applicant did not change their legal entity, name or address. 

Renewal Requirement:

1.  A power of attorney notarized and legalized up to the Sudanese Consulate.

2.  Trademark registration number and class.

3.  Date of expiration of the trademark registration.

Assignment Requirement:

1.   Simply signed power of attorney.

2.   Deed of assignment legalized up to the Sudanese consulate.

3.   Trademark certificate of registration for endorsement.

4.  Extract from the commercial register or certificate of incorporation of the assignee, legalized up to the Sudanese Consulate.

Kindly note the following points:

1.  Time frame from filing up to registration is about 24-28 months.

2.  Trademarks are registered for 10 years and renewable for another 10 years.

3.  Opposition period is for 8 months as from publication date.

Patents

Filing Requirements:

1.   A power of attorney notarized and legalized up to the Sudanese Consulate.

2.  A certified copy of the certificate of incorporation of the applicant company and its articles of incorporation duly legalized up to the Sudanese Consulate. A certified and legalized translation is required if the document is not in either the English language or the Arabic language.

3.   Two copies of the patent specification and claims. An Arabic translation of the abstract of the invention only is required.

4.   Two sets of the formal drawings, if available.

5.   A priority document if priority to be claimed.

Designs

Filing Requirements:

1.   A power of attorney notarized and legalized up to the Sudanese Consulate.

2.   The certificate of Incorporation of the applicant, legalized up to the Sudanese Consulate.

3.   Certified translation into Arabic of the contents of the application and its enclosures

      legalized up to the Sudanese Consulate.

4.  Specimen of the material of which the Industrial design is made or a photographic picture or sketch drawing of the industrial design in color if possible or an architectural model or any other means of production which is shown by such representation.

5.   Certified copy of the priority document if it is to be claimed.
